1. General Information
The online store is operated by Krzysztof Koch, visual artist and photographer, selling his own artistic works (photo books, prints, limited editions).
Sales are conducted as private, artistic transactions, not as a commercial business within the meaning of Polish and EU consumer-trade legislation.
Each item offered constitutes a limited art edition, individually signed and numbered.
2. Products and Editions
All items offered in the store are original artistic works protected under the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws 2022, item 2509).
Minor variations between copies may occur due to the manual printing or binding process.
Availability is limited to the quantity indicated for each edition.
3. Orders and Payments
Orders are placed through the website www.krzysztofkoch.com/store.
The buyer receives an email confirmation upon placing an order.
Payments are processed through Squarespace’s secure payment gateways or other authorised providers.
The artist reserves the right to cancel an order if the product is no longer available.
4. Shipping and Insurance
All shipments are insured by the courier service to the full value of the order.
Any visible damage to the parcel must be reported immediately to the courier and to the seller within 3 days of delivery.
In the event of a confirmed damage claim, the product will be replaced (if another copy is available) or refunded in full.
5. Returns and Right of Withdrawal
Due to the unique and artistic nature of the works, purchases are non-returnable and non-refundable, in accordance with Article 16(c) of Directive 2011/83/EU on Consumer Rights, transposed into Polish law as Article 38(2) of the Act of 30 May 2014 on Consumer Rights (contracts for goods made to the consumer’s specifications or clearly personalised).
Exceptions apply only if the artwork was damaged in transit or delivered incorrectly
6. Data Protection
Personal data provided during the purchase are processed in accordance with the Privacy Policy and with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR).
7. Governing Law
These Terms and Conditions are governed by Polish law and the laws of the European Union, including:
Regulation (EU) 2016/679 (GDPR),
Directive 2011/83/EU on Consumer Rights,
The Polish Civil Code (Act of 23 April 1964),
The Act on Copyright and Related Rights (Journal of Laws 2022, item 2509),
The Personal Income Tax Act (Journal of Laws 2024, item 226).
8. Artist’s Legal Status Declaration
The sale of artworks through this website is conducted by Krzysztof Koch in his capacity as an individual artist, in accordance with Article 3(1) of the Polish Entrepreneurs’ Law (Journal of Laws 2018, item 646).
This article defines business activity as an “organised, profit-making activity, carried out on a continuous basis.”
The artist’s activity does not meet these cumulative criteria and therefore does not constitute a business activity.Income derived from the sale of artworks is classified as income from copyrights and related rights under Article 18(1) and Article 22(9)(3) of the Polish Personal Income Tax Act, allowing for 50% deductible costs for authors.
The sale is carried out privately and artistically, as permitted by Polish and EU law, within the scope of creative expression and authorship.
Each artwork or edition is a signed and numbered original, accompanied by a certificate of authenticity, ensuring its artistic character.
9. Final Provisions
Placing an order constitutes acceptance of these Terms & Conditions.
The artist reserves the right to amend the Terms to comply with legal or operational changes. Updated versions will be published on the website.
Any disputes shall be resolved under Polish civil law, with mutual respect for the artistic and non-commercial nature of this activity.
